根据《国务院关于职工工作时间的规定》，每周职工法定工作时间平均为44小时。每月实际工作天数为：（365－7－52－26）÷12＝23.33（天）。为便于计算，可统一规定每月法定工作天数为23.5天，或按每月实际工作的日历天数，小时工资亦可按此进行折算。

一、规范再就业服务中心的运作。下岗职工进入再就业服务中心一定要签订基本生活保障和再就业协议，协议应明确双方的责任、权利和义务，并应明确协议期内实现再就业或协议期满的，均应与再就业服务中心解除协议，并与原企业解除劳动关系。凡进入再就业服务中心的下岗职工未与再就业服务中心签订协议的，要尽快补签。

二、规范提法。今后，各地在文件和上报材料中，不应再使用“托管”、“托管中心”、“托管协议”、“托管率”等不规范的提法，而应使用规范的提法：如进入再就业服务中心、签订基本生活保障和再就业协议（或简称“进中心协议”）、进入再就业服务中心的下岗职工比例等。“协议保留劳动关系”应规范为“协议保留社会保险关系”。行业或政府部门办的再就业服务中心应规范为再就业服务指导中心。
